1. ACCEPTABLE USE POLICY

This Acceptable Use Policy defines the parameters for accessing and utilizing the Website, marketing tools, code frameworks, and advertising channels managed by the Company. Any use of our systems that compromises performance or violates local laws is strictly prohibited.

Prohibited Activities List:

  • Deploying scripts or bots for illegal activity or unauthorized access attempts.
  • Transmitting malicious programs, trojans, ransomware, or keyloggers.
  • Engaging in system attacks, SQL injections, or server overloading.
  • Scraping, mining, or extracting data from our location-specific landing pages.
  • Sharing dashboard credentials or client credentials with unauthorized third parties.
  • Creating multiple user accounts to bypass account restrictions or payment defaults.
  • Attempting to reverse-engineer our custom Astro.js layouts or sitemap crawlers.
  • Filing false payment disputes or fraudulent gateway claims.
  • Using our GMB optimizations to list nonexistent storefronts or dummy addresses.
  • Sending unsolicited spam, marketing broadcasts, or phishing emails.

**Consequences of Violation:** Violation of this policy results in the immediate termination of all active campaigns, access restrictions, and blacklisting from future services. The Company reserves the right to report illegal activities to the **Cyber Crime Cell of Navi Mumbai** and seek damages up to **₹10,00,000 INR**.

2. CANCELLATION POLICY

We maintain clear cancellation policies across our services to protect campaign performance and upfront investments.

  • **Web Design Projects:** The Client can cancel web projects at any time before design approval. Setup fees and domain costs are non-refundable once registered.
  • **Monthly Ad Management Retainers:** Billed monthly in advance. To cancel, the Client must provide a **15-day written notice** before the next billing cycle. If notice is given later than 15 days, the current month will be billed in full, and the cancellation will take effect the following month.
  • **Reactivation:** Paused accounts due to late payments require a **₹2,000 reactivation fee** to cover account restructuring and ad redeployments.
  • **Access Removal:** Upon termination, all agency partner access to Meta Business Managers, Google Ads, and GMB accounts will be removed within **48 hours**. The Client must remove our agency permissions from their platforms.

3. DPDP ACT 2023 COMPLIANCE NOTICE

In compliance with Section 5 of the **Digital Personal Data Protection Act, 2023 (DPDP Act)**, this notice details the categories of personal data we collect, process, and store, and your rights as a **Data Principal**.

Processed Categories & Purpose:

We collect names, emails, mobile numbers, WhatsApp numbers, and business metrics to configure ad campaigns, construct web previews, process payments, and verify identities. Processing is done with your explicit, specific, informed, and withdrawable consent, or for contractual obligations.

Your Rights as a Data Principal:

  • **Right to Information:** Access details about your personal data processed by us and the processing activities performed.
  • **Right to Correction & Erasure:** Request updates to incorrect records or permanent deletion of your data when the consent purpose is completed.
  • **Right to Nominate:** Nominate another individual to exercise your rights in the event of death or incapacity.
  • **Right to Grievance Redressal:** Submit formal complaints to our Grievance Officer, or escalate unresolved disputes to the **Data Protection Board of India (DPBI)**.

4. GRIEVANCE REDRESSAL POLICY

In compliance with the IT Act 2000 and the DPDP Act 2023, we provide a structured grievance redressal mechanism for all users:

  • **Level 2 (Grievance Officer):** Formal complaints escalated to the Grievance Officer. Acknowledged within 24 hours and resolved within 15 business days.
  • **Level 3 (Company Head):** Escalated directly to the founder. Final agency decision within 15 days.
  • **Level 4 (Arbitration):** Binding arbitration held in Navi Mumbai, Maharashtra.

6. WHATSAPP COMMUNICATION POLICY

We use WhatsApp Business APIs (+91 9082543992) to facilitate fast campaign updates, previews, and support communications:

  • **Consent:** By submitting your number on our website forms, you consent to receive updates, reports, and marketing messages on WhatsApp.
  • **Opt-Out:** You can opt-out at any time by replying **"STOP"** to our chat thread or emailing roasbodhi@gmail.com.
  • **Legal Validity:** In accordance with the IT Act 2000, written project approvals, design sign-offs, and payment confirmations sent via WhatsApp are legally binding.
  • **Grievance Policy:** Abuse, threat messages, or spamming inside our support chats will result in the immediate termination of services.

7. CLIENT ONBOARDING CHECKLIST

To ensure compliance and smooth project execution, all Clients must complete the following onboarding steps:

  • **KYC Verification:** Provide business registration proof (GSTIN certificate, Proprietorship PAN, or Partnership Deed) and registered address verification.
  • **Agreement Execution:** Sign the Master Service Agreement (MSA) template digitally.
  • **Platform Access:** Grant agency permissions to Meta Business Managers, Google Ads managers, or Google Business Profiles.
  • **Onboarding Brief:** Complete our campaign brief details (budget allocations, target locations, top competitor keywords).

8. DATA PROCESSING AGREEMENT (DPA)

This Data Processing Agreement (DPA) defines the data privacy roles and obligations when the Company processes personal data on behalf of the Client:

  • **Roles:** The Client acts as the **Data Controller** (determines the purpose of processing), and the Company acts as the **Data Processor** (processes data strictly on the Client's written instructions).
  • **Data Security:** The Processor implements reasonable security practices (SSL encryption, access controls, database isolation) to protect customer details from unauthorized access.
  • **Breach Notification:** In the event of a security breach affecting the Client's customer data, the Processor will notify the Controller within **72 hours**, detailing the breach and mitigation steps taken.
  • **Data Deletion:** Upon termination of services, the Processor will delete or return all customer data in its possession, unless statutory storage mandates require retention.
